Terms of Use

1. Acceptance of Terms

Welcome to Echo Designs, operated by Haider Nawaz ("we," "us," or "our").

By accessing or using Echo Designs at echodesigns.space (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Echo Designs is a web-based phone mockup generator that allows users to:

  • Create device mockups with custom artwork
  • Use and customize templates
  • Export high-resolution mockups
  • Share templates publicly (optional)

2.1 Free and Paid Features

  • Free Tier: Limited exports, basic features
  • Pro Subscription: Unlimited exports, high-resolution, additional features
  • Credits: Pay-per-export alternative to subscription

3. Account Registration

3.1 Creating an Account

  • You must provide accurate and complete information
  • You must be at least 13 years old to use the Service
  • You are responsible for maintaining the security of your account
  • You may not share your account with others
  • One account per person

3.2 Account Security

  • Keep your password secure
  • Notify us immediately of unauthorized access
  • You are responsible for all activity under your account

4. Subscriptions and Payments

4.1 Pro Subscription

  • Billed monthly or annually via Paddle
  • Auto-renews unless canceled
  • Cancel anytime through your account settings
  • Cancellation takes effect at the end of the current billing period

4.2 Credits

  • Credits can be purchased for pay-per-export usage
  • Credits do not expire unless your account is deleted
  • Credit purchases are subject to our 14-day refund policy (see section 4.3 below)

4.3 Refunds

We offer a 14-day money-back guarantee for all purchases and initial subscription payments to comply with consumer protection laws.

To be eligible for a refund, you must request it within 14 days of the purchase date, and your account must show minimal or no usage of the Service (e.g., fewer than 2 exports for Pro subscriptions or credit purchases). This helps prevent abuse while ensuring fair access.

Refunds for credits are available only if the credits remain fully unused.

All refund requests should be submitted to billing@echodesigns.space or through Paddle's support at help@paddle.com. We/Paddle will review requests on a case-by-case basis and process approved refunds within 5-10 business days.

No refunds are available for renewal payments, partial months, or if you've exceeded the usage threshold, except where required by applicable law (e.g., if charged in error).

If you believe you were charged in error or need help with billing, contact billing@echodesigns.space.

4.4 Price Changes

  • We may change prices with 30 days notice
  • Existing subscriptions continue at current price until renewal

5. User Content and Ownership

5.1 Your Content

  • You retain all ownership rights to templates and artwork you create
  • You grant us a license to store, process, and display your content as necessary to provide the Service
  • You can delete your content at any time

5.2 Public Templates

  • If you submit a template for approval to the public gallery, you grant other users a license to view and use that template
  • Public templates are visible to all users
  • You can withdraw templates from the public gallery at any time

5.3 Content Responsibility

  • You are responsible for the content you upload
  • You must have rights to any artwork or images you use
  • Do not upload copyrighted material without permission

5.4 Commercial Use License

  • You may use the mockups and exports you create with Echo Designs for personal or commercial purposes, including marketing, app store listings, websites, and client work
  • You must have the rights to any screenshots, artwork, or other materials you upload
  • You may not resell, redistribute, or sublicense Echo Designs templates, device frames, or UI assets as standalone products outside the Service

6. Acceptable Use Policy

You agree not to:

  • Upload illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Upload malware, viruses, or harmful code
  • Harass, threaten, or abuse other users
  • Impersonate others or misrepresent your identity
  • Use automated tools to scrape or collect data from the Service
  • Attempt to gain unauthorized access to the Service
  • Interfere with the Service's operation

Violation of this policy may result in account suspension or termination.

7. Intellectual Property

7.1 Our Property

  • Echo Designs, including its code, design, branding, and features, is owned by us
  • You may not copy, modify, distribute, or create derivative works

7.2 User Content

  • You retain ownership of your templates and artwork
  • We do not claim ownership of your content

7.3 Public Gallery License

  • Public templates are licensed for use by all Echo Designs users
  • Users may customize and export public templates
  • Public templates remain attributed to the original creator

8. Prohibited Activities

You may not:

  • Reverse engineer, decompile, or disassemble the Service
  • Circumvent payment systems or security measures
  • Resell or redistribute access to the Service
  • Create a competing service using our platform
  • Use the Service for commercial purposes without proper licensing

9. Service Availability

9.1 "As Is" Service

  • The Service is provided "as is" without warranties
  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue features at any time

9.2 Maintenance

  • Scheduled maintenance may cause temporary downtime
  • We will provide notice when possible

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • WE MAKE NO WARRANTIES ABOUT THE SERVICE'S RELIABILITY, AVAILABILITY, OR ACCURACY
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE OR FREE FROM BUGS OR VIRUSES
  • YOUR USE OF THE SERVICE IS AT YOUR OWN RISK

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • WE ARE NOT LIABLE FOR DATA LOSS (you should back up your work)
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS

Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your content

13. Termination

13.1 By Us

  • We may suspend or terminate your account for violations of these Terms
  • We may terminate your account with or without cause with reasonable notice
  • Upon termination, your right to use the Service ceases immediately

13.2 By You

  • You may cancel your account at any time through account settings
  • You may request data deletion

13.3 Effect of Termination

  • Your subscription will be canceled
  • Your data will be retained for 30 days, then permanently deleted
  • Some data may be retained for legal compliance

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law provisions.

14.2 Venue

Any legal action must be brought in the courts of Pakistan.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting a notice on the Service
  • Sending an email to your registered address

Your continued use after changes constitutes acceptance of the updated Terms.

16. Miscellaneous

16.1 Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.

16.2 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver.

16.4 Assignment

You may not assign these Terms. We may assign our rights and obligations.
